How foreclosure works in North Carolina

Most North Carolina foreclosures go through a hearing before the Clerk of Superior Court. If the clerk allows the sale, it's scheduled and advertised, and after the sale there is a 10-day upset bid period during which higher bids can be placed.

Up until the sale is final, the homeowner can often still sell the house, pay off the loan at closing, and keep whatever equity is left over.

Selling before the sale date

If your home has equity, a sale can pay the lender in full and put the remainder in your pocket rather than losing it at auction. A foreclosure can also stay on your credit report for years, which a completed sale may help you avoid.

We can move quickly when a date is close. The closing attorney will request a payoff from your lender, including missed payments and fees, so you know exactly where you stand.

Other options worth asking about

Selling isn't right for everyone. Depending on your situation, your lender may offer a repayment plan, forbearance, or loan modification. A HUD-approved housing counselor can walk you through those options at no cost, and a real estate attorney can advise on your rights. We'll tell you plainly if another path looks better for you.
